The Chief Minister has been forced to change his plan to appoint Treasury Minister Eddie Teare as the temporary head of education.
Mr Teare volunteered for the job after Peter Karran was sacked.
However, it's emerged there's a law that prevents any political member of Treasury from performing a role in another department.
Health Minister David Anderson will now take on the job for the time being.
Allan Bell is off-Island at a British-Irish Council meeting and will choose a permanent replacement when he returns.
