Lawyers for the company haven't been instructed over the collapse of a deal between the promoter and the Department of Economic Development.
It says due to this the matter is not 'sub judice' as has been claimed by the government.
The company says it's still waiting for an explanation of why the tender process for the 10-year contract has been cancelled.
