The government's launched a consultation to bring its bankruptcy laws up to date.
Some of the current legilslation dates back to the 1800s.
A spokesman said the eight-week consultation is part of a three-phase programme of reform.
The treasury wants views from individuals, businesses, investors and those who support people who have "fallen in debt".
